1. Agreement to Terms

Welcome to NeroAero ("we," "us," "our," or "Company"). These Terms of Service ("Terms") are a legal agreement between you ("User," "you," or "your") and NeroAero. By accessing, browsing, or making a purchase on our website (the "Service"), you agree to be bound by these Terms. If you do not agree to all of these Terms, you must not use this Service.

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting to the website. Your continued use of the Service after changes constitutes your acceptance of the new Terms.

2. Product Information & Accuracy

We strive to provide accurate descriptions, photos, and specifications for all products. However, we do not warrant that descriptions, photos, pricing, or other content is accurate, complete, or error-free.

Product Compatibility: It is your responsibility to verify that products are compatible with your vehicle before purchase. We provide fitment information to the best of our ability, but we are not responsible for incompatibility issues. Verify VIN, model year, and specific vehicle requirements before ordering.

Pricing: All prices are in the currency listed on the checkout page and are subject to change without notice. We reserve the right to limit quantities or cancel orders if pricing errors occur.

3. Eligibility & Restrictions

You agree that:

  • You are at least 18 years of age
  • You will not resell, redistribute, or use products for commercial purposes without written permission
  • You will not purchase in bulk quantities for resale (dropshipping/retail resale)
  • You have the legal authority to enter into this agreement
  • You will use the Service in compliance with all applicable laws

Violations of these terms may result in order cancellation and account suspension.

4. Product Warranty

12-Month Manufacturing Defect Warranty: All NeroAero automotive parts are warranted against manufacturing defects for twelve (12) months from the date of purchase.

What's Covered:

  • Manufacturing defects in materials or workmanship
  • Failure due to factory defects under normal use
  • Parts that don't match our product description

What's NOT Covered:

  • Normal wear and tear
  • Damage from installation or improper use
  • Damage from accidents, collisions, or environmental factors
  • Modified, altered, or customized parts
  • Parts used outside manufacturer specifications
  • Damage from failure to follow installation instructions
  • Cosmetic damage that doesn't affect function

Making a Warranty Claim:

  1. Contact us at hello@neroaero.com within 30 days of discovering the defect
  2. Provide your order number, photos, and description of the issue
  3. We'll inspect the part and determine warranty eligibility
  4. If approved, we'll provide a replacement or full refund

Note: You must notify us within 12 months of purchase. We have no obligation to honor claims made after 12 months.

5. Order & Payment

Order Acceptance: Your submission of an order is an offer to purchase. We reserve the right to accept or reject any order for any reason, including suspected fraud, insufficient inventory, or policy violations. We'll confirm acceptance via email.

Payment Methods: We accept major credit cards, PayPal, and other payment methods displayed at checkout. Payment must be received and verified before order processing begins.

Payment Authorization: By providing payment information, you authorize us to charge your account for the order total, including applicable taxes and shipping. You represent that you are the authorized user of the payment method provided.

Billing Address: Your billing address must match your payment method records. We are not responsible for orders rejected due to billing mismatches.

6. Shipping & Delivery

Shipping Regions: We currently ship to the United Kingdom, United States, European Union, and Australia.

Shipping Times:

  • Standard processing: 2-3 business days
  • Standard shipping: 5-10 business days (varies by location)
  • Express options available at checkout
  • Delivery estimates are approximations, not guarantees

Risk of Loss: Products are at your risk once shipped. We recommend insured shipping for high-value items.

Delivery: You are responsible for providing an accurate delivery address. We are not liable for packages lost, delayed, or delivered to incorrect addresses due to customer error.

International Shipping: International customers are responsible for any customs duties, taxes, or fees imposed by their country. These are not included in product pricing.

7. Returns & Refunds

See our separate Return and Refund Policy for complete details on returns, refunds, and exchanges. That policy is incorporated into these Terms by reference.

In the event of conflict between this document and the Return Policy, the Return Policy controls all matters related to returns and refunds.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Lost profits, lost revenue, or lost data
  • Business interruption or loss of business opportunity
  • Damage to vehicles or property resulting from product use or failure
  • Personal injury claims

Total Liability Cap: In no case shall our total liability exceed the amount you paid for the product that caused the claim.

Some jurisdictions do not allow limitation of liability, so this may not apply to you.

9. Warranty Disclaimer

EXCEPT AS EXPRESSLY STATED IN SECTION 4 (PRODUCT WARRANTY), PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that products will meet your expectations, be error-free, or be uninterrupted.

10. Intellectual Property

All content on the NeroAero website, including text, photos, logos, and descriptions, is owned by or licensed to NeroAero and protected by copyright and other intellectual property laws.

You may not:

  • Copy, reproduce, or distribute content without written permission
  • Use our photos or descriptions for competing businesses
  • Modify or create derivative works from our content
  • Remove or alter copyright notices

User Content: If you provide feedback, reviews, or suggestions, you grant us a non-exclusive, royalty-free license to use that content.

11. User Accounts

Account Creation: If you create an account, you agree to:

  • Provide accurate, complete, and current information
  • Maintain the security of your password
  • Notify us immediately of unauthorized access
  • Not share your account with others

Account Suspension: We may suspend or terminate accounts that violate these Terms, engage in fraud, or misuse the Service.

Optional Accounts: Account creation is optional. You may make purchases as a guest without creating an account.

12. User Conduct

You agree not to:

  • Use the Service for illegal purposes or in violation of any laws
  • Engage in harassment, fraud, or deception

Violations may result in immediate account termination and legal action.

Governing Law: These Terms are governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles.

Jurisdiction: You agree that any dispute shall be resolved in the courts located in the United Kingdom. You consent to the exclusive jurisdiction of these courts.

14. Indemnification

You agree to indemnify, defend, and hold harmless NeroAero and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses arising from:

  • Your violation of these Terms
  • Your use of the Service
  • Your products or the way you use them
  • Your violation of any third-party rights

15. Third-Party Links & Content

Our Service may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of third-party sites. Your use of third-party sites is at your own risk and subject to their terms of service.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if not possible, severed. The remaining Terms will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Return and Refund Policy and any other policies posted on our website, constitute the entire agreement between you and NeroAero regarding your use of the Service and supersede all prior agreements and understandings.
